Court expert opinions & advisory expert work
When a court, bank or investor asks for a number that holds - that number is our work. Nine years of court practice in commercial and criminal proceedings before courts in Podgorica, Nikšić, Cetinje, Bar and Berane. We also cover cases in Serbia, BiH and Croatia through our Adria partner network. Reviews of opposing expert reports in 24-48 hours. A written critique an attorney can present at hearing immediately. We follow OECD transfer pricing guidelines, RICS and IVS valuation standards, IFRS for financial expert work, ISA for audit. A finding that holds under cross-examination because it's mathematics, not opinion. Typical cases: foreign investor entering a Montenegro hotel - we do buy-side DD and valuation. Commercial court requests expert work for a partnership dispute - we lead the case through three instances. Tax authority challenges a transfer price - we defend the methodology up to the Administrative Court. Clients include law firms in Podgorica-Belgrade-Zagreb, foreign investment funds, banks across Montenegro and the region, ministries.

What we do
Court expert opinions
Commercial proceedings, criminal proceedings, inheritance disputes, administrative disputes, labor disputes. Appointments by courts in Podgorica, Nikšić, Cetinje, Bar, Berane, Herceg Novi. Written reports 30-200 pages depending on complexity. Oral defense at hearing with written preparation for the attorney. Witness testimony as expert before commercial court, criminal chamber, professional chamber tribunal. We've handled cases from 50K to 50M EUR in dispute value.
Reviews of expert reports
Opposing expert findings you suspect don't hold. Review in 24-48h. Written critique referencing methodological standards, faulty assumptions, computational errors, non-compliance with IFRS / IVS / OECD / RICS. Often overturns first-instance decisions and opens grounds for appeal. A review is a formal expert critique that carries weight before the second-instance court - not lay opinion.
Advisory expert work for attorneys
The silent consultant. Not court-appointed - working for the party. We prepare the attorney for questioning the opposing expert, where to look for contradictions, how to present a counter-thesis before the court. We attend the hearing as observers with a page of questions. This role is invisible on paper but shifts outcomes in commercial disputes.
Business valuations (RICS / IVS)
DCF, multiples, asset-based approach. Goodwill, brand, intellectual property. Acquisitions, splits, partner disputes, inheritance proceedings, refinancing, management buyouts. Certified appraiser in the Montenegro registry and the IVS registry. Typically 50-300 pages with an Excel model delivered alongside the finding.
Real estate valuations (akvila.me)
Apartments, houses, commercial space, plots, hotels, factories, marinas, development land. Bank, court, inheritance, sale, mortgage encumbrance, insurance. Per IVS / RICS standards. Market, mortgage and insured value. We cover Montenegro completely, regional via partners. Akvila.me is our specialized real estate platform with over 4,000 reference transactions in the database.
Transfer pricing (OECD) - dedicated focus of the house
Transfer pricing is the point where multinational firms lose the most time and money - not because they don't know the methodology, but because tax authorities demand documentation that cannot be improvised on the eve of an audit. Schule produces transfer pricing files to OECD Transfer Pricing Guidelines 2022 and BEPS Action 13 standards - Master File, Local File, Country-by-Country Report (CbCR) where applicable. We prepare benchmarking studies using Berry ratio, TNMM (Transactional Net Margin Method), CUP (Comparable Uncontrolled Price), profit split, or resale price method - depending on the transaction profile. Comparability analysis runs on public and licensed databases (Amadeus, RoyaltyStat, Bloomberg, Orbis, ktMINE). Our clients include: local subsidiaries of multinationals in Montenegro, holding structures with intra-group transactions, IT firms with transfer licenses (royalty, software, IP), manufacturers with cost-plus distribution models, financial institutions with intra-group credits and guarantee fees. We specialize in TP Master File (group documentation), Local File (per-jurisdiction documentation), CbCR (groups above EUR 750M consolidated revenue), APAs (Advance Pricing Agreements), MAP procedures for double taxation avoidance, DEMPE analysis for IP licensing, intra-group financing benchmark with interest rates and guarantee fees, TP risk assessment and policy framework. The arm's length principle is defended by numbers, not opinion - that is what distinguishes our approach from bookkeeping.
TP Master File (group-level documentation)
Master File is the group-level document for the entire multinational - organizational structure description, intangibles (IP/brand/know-how), intra-group financial activities, financial and tax position. Per BEPS Action 13 standard with 5 mandatory sections. We write in English (default for EU/DACH/CIS jurisdictions), translating where needed (Montenegro, RU, ZH, AR on request). Typically 40-90 pages with supporting annexes. We coordinate with group tax directors in DACH, GCC, China - alongside local TP teams in each jurisdiction. Timeline 4-6 weeks with available data and interviews of key group personnel.
TP Local File (per-jurisdiction documentation)
Local File is the local-entity document - description of local intra-group transactions, comparability analysis, choice of TP method, benchmarking. We produce it for the Montenegro entity, but also for sister entities wherever the client operates (Serbia, BiH, Croatia, Slovenia, EU, GCC). Each local jurisdiction has specific rules on transaction thresholds, format, submission language and deadlines - which cannot be unified. Standalone Local File 2-3 weeks; combined Master + Local 4-6 weeks. Per OECD guidelines, BEPS Action 13, and the specific Montenegro Regulation on Transfer Pricing.
Country-by-Country Report (CbCR)
CbCR is mandatory for groups with consolidated revenue above EUR 750M - an annual report on global allocation of revenue, taxes and business activities per jurisdiction. Per BEPS Action 13 and OECD CbCR XML schema. We prepare the CbCR file with all 12 mandatory columns (Total revenue, Profit before tax, Income tax paid, Income tax accrued, Stated capital, Accumulated earnings, Number of employees, Tangible assets, plus business activity tagging). Coordination with group tax director, master entity (UPE) finance team, and local accountants in each jurisdiction. Submission via tax authority portals (Montenegro, EU, GCC, CIS, China).
Benchmarking studies (comparables search + statistical analysis)
Benchmarking is the technical core of TP - finding comparable independent transactions or companies that justify the client's arm's length price. We use Amadeus (Bureau van Dijk) for EU/Adria comparables, RoyaltyStat for royalty rates, Bloomberg for interest rates and FX, Orbis for group structures, ktMINE for IP licensing rates. Statistical processing: interquartile range (IQR), median, Berry ratio analysis. Cleanup process (eliminating loss-making, inactive, acquired, M&A target firms). Typically 2 weeks per standalone benchmark study, parallel to Local File preparation. All documented with screenshots from the database for court defense.
TP Policy (Transfer Pricing Policy) - internal group document
TP Policy is the internal document that prescribes how the group prices intra-group transactions - rules per category (services, royalty, financing, goods), procedure for new transactions, governance and controls. Not legally mandatory, but PE funds and strategic investors demand it in DD as proof the group knows what it's doing. We write a TP Policy 25-50 pages with flowcharts, process diagrams, RACI matrix. Cooperation with the group CFO and local finance directors. Typically 4-6 weeks from kick-off to final policy. Annual update or whenever the group restructures.
TP audit defense (representation before tax authorities)
When the Montenegro Tax Authority, Serbian, EU or other tax authorities open a TP audit, we are first contact - advisory expert work for the defense attorney, technical preparation of responses to tax authority requests, presence at inspection meetings, escalation to the Administrative Court where needed. A typical TP audit lasts 6-18 months from opening to ruling. Our input covers methodology, documentation, benchmarking, argumentation - everything the attorney can present directly before the tax authority. Nine successfully defended TP audits with the client's methodology retained; average tax saving 300K-1.5M EUR per case.
Advance Pricing Agreement (APA) - pre-agreement with tax authorities
APA is a binding agreement between taxpayer and tax authority on TP methodology for future transactions (3-5 years forward). We prepare unilateral APA (Montenegro tax authority only), bilateral APA (Montenegro + other jurisdiction via MAP), multilateral APA (3+ jurisdictions). Typically 18-36 months from opening to signing, with benchmarking study, legal analysis, MAP procedure through the OECD framework. APA process cost is significant but ROI is high - eliminates TP risk for 3-5 years, enables precise tax planning, reduces annual compliance cost.
TP risk assessment (self-assessment of exposure)
TP risk assessment for firms that don't yet have documentation but know they have intra-group transactions - what to do before an audit arrives, which transaction category carries the highest risk, where benchmarking is already in trouble. Typically 2-3 weeks with access to financial statements and a list of intra-group transactions. Output: risk matrix with Red/Amber/Green flags per category, action plan proposal (what to do in 3, 6, 12 months), rough budget for full documentation. An accessible entry point into the TP world for firms that have never produced documentation.
Intra-group financing (interest rates, guarantees, cash pooling)
A specific area of TP - intra-group loans, mezzanine financing, guarantee fees for group guarantees, cash pooling (notional vs physical), back-to-back loans. Benchmarking interest rates on public and licensed databases (Bloomberg for sovereign rates, S&P/Moody's for corporate spreads, local banking sources). We document the debtor's credit rating per Moody's methodology, calculate arm's length spread, document notional vs physical pooling routes. Particularly relevant for groups with centralized treasury functions (DACH, EU, GCC structures). Pricing defended to OECD Master File standard.
IP licensing and royalty rates (DEMPE analysis)
The most complex segment of TP - IP licensing between group entities (software, brand, patents, know-how). We produce DEMPE analysis (Development, Enhancement, Maintenance, Protection, Exploitation) - who in the group actually develops the IP, where substantive risk sits, who has the right to royalty. Benchmarking royalty rates via RoyaltyStat and ktMINE databases (5,000+ comparable licenses per sector). Particularly relevant for IT firms with offshore IP holding structures, hotel groups with brand licensing, manufacturers with China-EU know-how transfers. Per OECD TPG Chapter VI and BEPS Action 8-10 standards.
Due diligence
Commercial, financial and tax DD. Pre-acquisition review of target company. Quality of earnings, EBITDA normalization, working capital, tax exposures, key customers and suppliers, contracts, HR, IT, legal. Daily reports under time pressure. Typically 4-8 weeks from kick-off to final report. Clients: PE funds, foreign strategic investors, Chinese partners, local family firms in sale processes.
Forensic analysis
Money laundering, fraud, related-party transfers, sham accounts, IP theft, suspect dealings with offshore structures. Analysis of hundreds of thousands of transactions with hypotheses and counter-evidence. SQL/Python for large datasets, AI tools for pattern detection, documentation to court standards. The finding holds before criminal court - we've written reports for cases before the Special Prosecutor's Office.
Damages assessment
Direct loss + lost profit. Traffic, contractual, professional liability, workplace injuries, damage from regulator inaction. Methodology per Obligations Act with case law from the Supreme Court of Montenegro and EU Court of Justice where relevant. We typically handle cases of 100K-10M EUR value.
Crisis consulting
A company in trouble - overdue payments, frozen accounts, creditors threatening, suppliers demanding cash, bank activating collateral. Restructuring plan, creditor negotiations, pre-bankruptcy or bankruptcy, crisis exit. Silent advisor or Acting CFO mandate. Nine successfully executed restructurings in the last 5 years.
Forensic expertise for cyber incidents
Digital forensics for cyberattacks and data leaks - chain of custody for evidence, log analysis, attack reconstruction, business impact quantification. Cooperation with CERT Montenegro and private cybersecurity firms. Special expertise in attacks on banking sector, e-commerce platforms and critical infrastructure. Written reports ready for criminal proceedings or insurance disputes. Per NIST SP 800-86 and ISO/IEC 27037 standards for digital evidence.
Intangible asset valuation (brand, goodwill, IP)
Valuation of trademarks, patents, copyrights, customer base, know-how, contractual rights, software, domains. Per RICS guidelines for intangible assets and IFRS 3 / IAS 38 rules. Methods: relief-from-royalty, multi-period excess earnings, cost-to-recreate. Typical for purchase price allocation post-acquisition, IP value disputes, intra-group license transfer pricing.
Bankruptcy and pre-bankruptcy financial analysis
Solvency and liquidity analysis for bankruptcy trustees and courts. Reconstruction of cash flows in the critical period (12-24 months pre-bankruptcy), identification of possible voidable transactions, related parties, fraudulent transfers. Assessment of realizable asset value in bankruptcy vs going-concern. Reorganization plan for pre-bankruptcy with cash flow projections and liquidation scenarios. Cooperation with trustees registered with the Ministry of Justice of Montenegro.
Damages from presumed liability
Professional liability (medical negligence, attorney error, design fault, accounting error), product liability, third-party damage. Expert work on causation, direct loss quantification + lost profit. Cooperation with insurance companies (Lovćen, Sava, Generali, Wiener Städtische) and specialized liability litigation attorneys. Typical 50K-2M EUR case value.

Why Schule
Nine years of court practice
Courts in Podgorica, Nikšić, Cetinje, Bar, Berane, Herceg Novi. Experience in commercial and criminal proceedings - every finding is defended before a judge. We're not academic advisors, not office-based. We stand behind every number we sign.
Review in 24-48h
Speed when you need it - a written critique of an opposing finding the attorney can present immediately. If our review fails to find an argument that seriously challenges the opposing report, we refund. The guarantee is in the standard contract.
Under one roof
Appraiser, accountant, forensic analyst, coach - all from the same house. One contract, one voice, one coordinator. No briefing external teams, no loss in communication, no coordination overhead.
Nine languages operational
A legal document submitted to court must be accurate in the court's language. We have native-level capacity for 9 languages - LAT/CIR Serbian, English, Russian, Chinese, Arabic, Turkish, German, Hebrew. No external translation link.
OECD/IVS/RICS standards
All expert work is written to international standards recognized in arbitration, EU courts, with Chinese partners, in GCC disputes. The standard is the language the opposing side hears - our finding isn't a local experiment, but a document that passes global review.
AI routine accelerator
Forensic analysis of hundreds of thousands of transactions in a minute. Pattern detection that doesn't fit into 100 manual hours. AI generates the hypotheses. The court expert verifies them with Benford's law, Z-score, and network analysis.
Adria region coverage
Network of collaborators in Montenegro, Serbia, BiH, Croatia, Slovenia, Albania. We can lead a cross-border case without an external coordinator. Local language, local procedural rules, local case law - all within the network.
Questions about expert work
- I have an opposing expert report - can you overturn it?
- 24-48h review and written critique. If our review doesn't find an argument that seriously challenges their finding - we refund. The guarantee is in the standard contract.
- How much does court expert work cost in Montenegro?
- Reviews from 800 EUR. Standard expert opinion 3,500-12,000 EUR depending on complexity. Complex DD and forensic analysis from 15,000 EUR. Exact amount with fixed guarantee - before start. No hourly billing.
- How long does it take?
- Review 24-48h. Expert opinion 2-6 weeks depending on complexity. DD 4-8 weeks. Under time pressure we work in parallel with other experts and deliver compressed without losing quality.
- What distinguishes your report from other experts?
- Written preparation for the attorney on how to present the report in court. Consultations during work at no extra charge. Mid-process draft for correction before final. Standards (IVS/OECD/IFRS) explicitly cited in the finding. Nobody else does this.
- Do you work outside Montenegro?
- Yes. Serbia, BiH, Croatia, Slovenia, Albania through the Adria network. EU via partners (Bartholdi Labs, Brussels). China via the MENHU network and BOLV lawyers. GCC through Arabic processing of materials.
- What's the difference between a court expert and a consultant?
- A court expert is appointed by ministerial decree, under statutory constraints of independence and accountability, defends the finding under criminal liability. A consultant works for the party, lacks court weight. We offer both - expert work for court, advisory for the attorney.
- What is transfer pricing and when do I need it?
- Transfer pricing is the amount related parties (parent-subsidiary, sister companies) charge each other for goods, services, interest, royalties. You need it if you have transactions over 75,000 EUR with a related party - Montenegro law requires master file and local documentation. Without these documents, the Tax Authority can reclassify and impose additional tax.
- How does AI help in financial forensics?
- Pattern detection across hundreds of thousands of transactions in a minute - phantom suppliers, circular flows, timing anomalies in payments, correlations between accounts that must never be correlated. Manually this would be 100+ hours. AI doesn't draw conclusions - it generates hypotheses the expert verifies. Without AI we're slow, with AI we're precise.
- Can I use your finding in arbitration (ICC, VIAC, LCIA)?
- Yes. Our findings are written per IVS and OECD standards recognized at ICC Paris, VIAC Vienna, LCIA London, HKIAC Hong Kong. The English version comes with the Serbian version - they match exactly. Chinese clients also get a Mandarin version through BOLV.
- How do you choose between valuation methods (DCF vs multiples vs asset-based)?
- Depends on the business and data. DCF when reliable projections exist and discount rate makes sense (5+ years operating, stable cash flow). Multiples when comparable transactions or publicly traded firms exist (EV/EBITDA, P/E, EV/Sales). Asset-based for holding companies, real estate-heavy businesses, or when going concern is in question. Typically we combine 2-3 methods and synthesize a value range - RICS and IVS standards require triangulation, not a single model.
- What should a client prepare before our conversation?
- For expert work: case number, stage of proceedings, hearing date, court and judge, brief dispute description (1-2 pages). For DD: target company financials 3 years, organizational structure, top 10 customers/suppliers, NDA. For review: opposing finding in PDF, our deadline. For transfer pricing: list of intra-group transactions, existing master file if any, financials of related parties. All sent to office@schule.co.me or via secure file sharing (Tresorit/Citrix ShareFile).
- What is the delivery format - PDF, presentation, executive memo?
- Standard: written report in PDF with numbered paragraphs (30-200 pages depending on complexity). Excel model alongside report for valuations and transfer pricing. Executive summary 2-4 pages with key numbers and conclusion for owner/management. PowerPoint presentation 12-18 slides for internal presentation (board, credit committee, M&A negotiations) where needed. For court mandates, all in two language versions when dispute has international component.
- What about confidentiality and NDA practice?
- NDA signed before every mandate. Standard NDA with 5-year confidentiality obligation, mutually binding. All client documents kept on encrypted servers (ISO 27001 principles). Access to materials limited to active team on mandate. Material deletion 12 months after mandate close unless client requests longer retention for legal defense. GDPR compliance in all steps.
- Do you accept rush mandates?
- Yes, with 30-50% rush premium. Rush defined as 50% of standard timeline or less (e.g., review in 24h instead of 48h, expert work in a week instead of 4 weeks). Rush availability depends on team capacity - we don't accept rush that would degrade another active mandate's quality. Largest rush: 80-page DD for transaction closing in 9 days with parallel team in Belgrade and Brussels.
- When are you required to have transfer pricing documentation in Montenegro?
- All firms with transactions with related parties have a TP documentation obligation. The 75,000 EUR per-transaction threshold grants the right to a simplified form - it does not eliminate the obligation. Large taxpayers do not qualify for the simplified form - a full TP study is mandatory for all controlled transactions. Legal basis: Article 38 of the Corporate Income Tax Law of Montenegro + Ministry of Finance Instruction 121/22 (Official Gazette of Montenegro). Large taxpayers submit documentation with their tax return; others keep it ready and provide it at the Tax Authority's request (30-45 day window). Transitional rule until 2027: deadline extended to June 30 for the previous year.
- What are BEPS Action 13 obligations for a Montenegro-based firm?
- BEPS Action 13 globally has three pillars (Master File, Local File, CbCR), but Montenegro has not formally introduced the concepts of Master File + Local File as separate documents into domestic regulation. MoF Instruction 121/22 prescribes a single local TP study with content substantively equivalent to the Master + Local File approach (group analysis, industry analysis, functional analysis, method selection, comparability, conclusion). CbCR has been in force since January 1, 2024 - for groups with an ultimate parent from a state with CbCR obligation (OECD threshold of 750M EUR consolidated revenue). Montenegro signed the MLI on November 11, 2025, ratified in May 2026, entering into force on September 1, 2026.
- Can you represent us in a TP audit?
- Yes, in advisory capacity (tax advisor for discussions with the Montenegro Tax Authority, preparation of responses to tax authority requests, presence at inspection meetings) plus technical defense of findings (benchmark methodology, comparability analysis, choice of TP method, statistical argumentation). Legal representation before the Administrative Court goes through a partner law firm - we are technical expert, the attorney is the formal representative. Nine successfully defended TP audits in the last 5 years with the client's methodology retained. Average tax savings 300K-1.5M EUR per case.
- How do you treat cash pooling and intra-group financing?
- We prepare benchmark interest rates from public and licensed databases (Bloomberg for sovereign rates, S&P/Moody's for corporate spreads, local banking sources for Adria region). We document notional vs physical pooling routes, calculate guarantee fees where the group guarantees a local loan, determine debtor credit rating per Moody's methodology to derive the arm's length interest rate. Particularly relevant for groups with centralized treasury functions (DACH, EU, GCC structures) and for firms with back-to-back loans through offshore entities. All documented to OECD Master File standard - defensible before tax authorities.
- How long does it take to prepare Master File + Local File for a mid-sized company?
- With available data and interviews with key personnel, combined Master + Local File: 4-6 weeks from kick-off to final draft. Standalone Local File (when the group already has Master File): 2-3 weeks. Benchmarking study additionally 2 weeks parallel to Local File preparation. Under time pressure (TP audit already open, short deadline from tax authority): 50% of standard timeline with rush premium 30-40%. CbCR file: 2-4 weeks depending on group complexity and number of jurisdictions. APA process (significantly longer): 18-36 months from opening to signature.
Have a court deadline?
Send the case and stage. We come back in 24 hours with price range and timeline.
